Warrant issued for the arrest of Dede Evavold

UPDATE (8:00 AM, Saturday, March 17, 2018) – A search of jail rosters from overnight shows that Dede Evavold remains at large. She was required to report to jail in Dakota County on March 9, 2018. Over a week later, her whereabouts are unknown. Evavold is from St. Cloud, but she may be traveling.

(2:15 PM, Wednesday, March 14, 2018) – A warrant was issued today for the arrest of Dede Evavold after she ignored a previous court order which ordered Evavold to “remove ALL blogs/postings, social media postings, or internet postings” about David Rucki, his children, and other members of the Rucki family which violate a Harassment Restraining Order.

Evavold was convicted in September 2016 of six felonies for her role in the disappearance of Samantha Rucki and her sister Gianna, who were abducted near their home on Lakeville by their mother Sandra Grazzini-Rucki, during a custody and divorce proceeding.

Since her release from jail last January, Evavold has repeatedly ignored the conditions of her probation by making repeated references to the Rucki family in her use of social media.

Court granted restraining order against Evavold

As previously reported by Missing in Minnesota, Evavold has repeatedly violated the explicit terms of her probation and the HRO by continuing to reference the Rucki family in her use of social media.

Last July, a court in Dakota County has found that “an immediate and present danger of harassment” by Dede Evavold exists to warrant the granting of an HRO requested by David Rucki and his daughter, Samantha Rucki, against Evavold.

The court further found that there are “reasonable grounds to believe that [Evavold] has harassed [David Rucki and Samantha Rucki] (or minor children included in the petition)…”

Specifically, the court found that Evavold “made threats” to David Rucki and Samantha Rucki, and that “the harassment has had or is intended to have a substantial adverse effect on [David Rucki and Samantha Rucki’s] safety, security, or privacy.”

Evavold is prohibited from having any “direct or indirect contact” with David Rucki, Samantha and Gianna Rucki, and two other minor Rucki children. Evavold is also prohibited from naming “any member of the Rucki family in any blog posting, social media posting, or internet posting.”

In the last year, Evavold’s blog has posted pictures of the Rucki family, their home in Lakeville, and the address to the home, in violation of the HRO and the conditions of her probation.

Evavold ignored court order to remove all posts about Rucki family or report to jail

DedeEvavoldVictorySignLargeOn March 1, 2018, Judge Kathleen Gearin ordered Evavold to remove the blog content by 9:00 AM on March 9, 2018, or report to jail in Dakota County.

As of 9:00 AM on March 9, Evavold had not removed the content, nor had she reported to jail in Dakota County, as ordered by Judge Kathleen Gearin.

Not only did Evavold ignore a court order to “remove ALL” posts about the Rucki family from her blog and social media accounts, but she also published new material on March 9, and added more content earlier today.

After Evavold missed the 9:00 AM deadline detailed in Judge Gearin’s order, the attorney for the Rucki family, Lisa Elliott, filed an Affidavit of Non-Compliance with the court because Evavold did not comply with Judge Gearin’s order.

Elliott also requested that a warrant be immediately issued for Evavold’s arrest for failure to comply with Judge Gearin’s order.

Judge Gearin signed the order that an arrest warrant be issued for Evavold earlier this week, and the warrant was issued in the last hour.

Rucki family attorney told court Evavold is “obsessed” with the family

Many who have witnessed Evavold in court believe she is repeatedly violating the HRO to trigger more court hearings, providing Evavold with the opportunity to remain in contact with the Rucki family.

At a court hearing last October, Elliott said that Evavold “seems obsessed with [the Rucki] family.”

In December, Evavold looked directly at David Rucki during a court hearing and asked in a resentful and villainous voice, “where is Samantha?”

Elliott sternly responded on behalf of David Rucki that she also represented Samantha Rucki, as well as the minor children and that Samantha had no obligation to appear in court.

David Rucki was awarded full custody of all five of his children in November 2013, while two of his daughters remained missing. David Rucki was reunited with his daughters days after they were found on a rural ranch in northern Minnesota.

They live with him and their other siblings at the family’s home in Lakeville.

Evavold lives in St. Cloud with her husband Darin.
